This website is operated by Amor Fati Wines. Throughout these Terms of Service, “Amor Fati Wines”, “we”, “us” and “our” refer to Amor Fati Wines.

These Terms of Service apply when you access our website, create an account or purchase products from us. They should be read together with our Privacy Policy, Shipping and Delivery Policy, and Return and Refund Policy.

By using our website or placing an order, you agree to these Terms of Service. If you do not agree to them, you should not use our website or place an order.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products for sale.

1. Age and responsible service of alcohol

You must be at least 18 years old to purchase or receive alcohol from Amor Fati Wines.

By placing an order, you confirm that:

• You are at least 18 years old
• Any person receiving the delivery is at least 18 years old
• You are not purchasing alcohol for, or on behalf of, a person under 18

We and our delivery partners may request valid photo identification before handing over an order.

Delivery may be refused if suitable proof of age cannot be provided, the recipient appears intoxicated, or we reasonably believe the alcohol may be supplied to a person under 18.

If delivery cannot be completed for one of these reasons, the order may be returned to us. Reasonable redelivery or return-to-sender costs may apply where permitted by law.

Amor Fati Wines operates under Victorian liquor licence number 36313702.

2. Website use

You must not use our website:

• For an unlawful or fraudulent purpose
• To breach another person’s rights
• To interfere with the website’s security or operation
• To transmit malicious code, viruses or harmful material
• To collect information about other users without lawful authority
• To reproduce or commercially exploit our website content without permission

We may suspend or restrict access to the website where reasonably necessary to protect our business, customers, systems or legal obligations.

3. Products and availability

All products are subject to availability.

We may limit quantities where reasonably necessary, including where stock is limited, an order appears to be for unauthorised resale, or we suspect fraud or misuse.

Adding an item to your cart does not reserve it. If a product becomes unavailable after you place an order, we will contact you and offer an appropriate alternative or refund the unavailable item.

We will not substitute a different wine or vintage without your agreement where the substitution would materially differ from the product ordered.

4. Product descriptions and images

We take reasonable care to ensure that product descriptions, vintages, prices and images are accurate.

Product images are illustrative, and label or packaging designs may change. If a material error affects an order, we will contact you before fulfilling it where reasonably possible.

We rely partly on information supplied by producers and distributors. We do not represent that a wine is formally certified organic or biodynamic unless that certification is expressly stated in its product description.

Nothing in this section limits your rights if a product is materially different from its description.

5. Natural wine characteristics

Many wines sold by Amor Fati Wines are made using low-intervention methods and may be unfined or unfiltered.

Natural characteristics can include:

• Sediment
• Cloudiness
• Variation between bottles or vintages
• Flavour characteristics associated with low-intervention winemaking

These characteristics do not necessarily indicate that a wine is faulty. However, this does not limit your rights where a wine is faulty, damaged, unsafe, not of acceptable quality or materially different from its description.

We do not provide returns or refunds solely because of personal taste preferences or change of mind.

6. Prices and payment

Unless otherwise stated, prices are displayed in Australian dollars and include GST where applicable.

Payment must be made using a payment method available at checkout. You confirm that you are authorised to use the selected payment method.

Prices and promotions may change without notice. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing or technical error.

If an obvious error affects your order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected item for a refund.

7. Orders and order acceptance

Submitting an order is an offer to purchase the selected products.

We may accept or decline an order for legitimate reasons, including:

• Product unavailability
• Pricing or product-information errors
• Payment problems
• Suspected fraud or unauthorised resale
• Delivery restrictions
• Liquor licensing requirements

If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.

We will use the contact details supplied at checkout to notify you about material order issues.

8. Customer information

You agree to provide complete and accurate account, billing, contact and delivery information.

You are responsible for checking the delivery address before submitting an order and contacting us promptly if you discover an error. We cannot guarantee that an address can be changed after dispatch.

9. Shipping and delivery

We deliver only to eligible addresses within Australia. We do not ship internationally.

Delivery methods, charges, requirements and estimated timeframes are described in our Shipping and Delivery Policy and displayed at checkout where applicable.

Delivery timeframes are estimates rather than guaranteed delivery dates. Carrier delays, extreme weather, public holidays and circumstances outside our reasonable control may affect delivery.

Risk in the products passes to you when the order is delivered to the nominated address or collected in accordance with an authorised delivery arrangement.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

10. Weather holds and wine storage

Wine can be affected by excessive heat and significant temperature fluctuations.

During extreme weather, we may reasonably delay dispatch, change the shipping method or use protective packaging. We will contact you if a material delay is required.

Before dispatch, Amor Fati Wines stores its wines under controlled conditions at approximately 14°C.

After delivery, you are responsible for storing and handling the wine appropriately. Deterioration caused by unsuitable storage or handling after delivery is not considered a product fault.

Nothing in this section excludes or limits your rights where a product was faulty, damaged or not of acceptable quality when supplied.

11. Returns, faults and refunds

Change-of-mind returns are not accepted.

If a product is faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible. We may request photographs, order information and, where reasonably necessary, that the affected bottle and packaging be retained for assessment.

Any request for evidence or inspection will be reasonable and will not restrict your rights under the Australian Consumer Law.

Returns, replacements and refunds are handled in accordance with our Return and Refund Policy and the Australian Consumer Law.

12. Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms of Service excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where permitted by law, our liability will be limited to the loss or damage that was reasonably foreseeable and directly caused by our breach.

13. Intellectual property

Unless otherwise stated, the content on this website, including text, branding, graphics, photographs and page designs, belongs to Amor Fati Wines or is used with permission.

You may view and use the website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify, sell or commercially exploit our content without written permission.

14. Third-party services and links

Our website may contain links to third-party websites or use services provided by third parties, including Shopify and payment or delivery providers.

We are not responsible for third-party websites that we do not control. Your use of a third-party service may also be governed by that provider’s terms and privacy practices.

This section does not limit our responsibility for services that we are legally responsible for providing to you.

15. Website availability

We aim to keep our website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or change parts of the website for maintenance, security, operational or legal reasons.

Nothing in this section excludes liability that cannot lawfully be excluded.

16. Severability

If any part of these Terms of Service is found to be unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining terms will continue to apply.

17. Governing law

These Terms of Service are governed by the laws of Victoria, Australia.

Nothing in this section prevents you from exercising rights available under applicable Australian consumer law or bringing a claim in a jurisdiction available to you by law.

18. Changes to these terms

We may update these Terms of Service to reflect changes to our business, website or legal obligations.

The current version will be published on our website. Changes will apply from the date they are published and will not retrospectively remove rights relating to an order already accepted.
