This website is operated by Amor Fati Wines. Throughout the site, the terms "we", "us" and "our" refer to Amor Fati Wines. Amor Fati Wines offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms", "Terms & Conditions"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
Our store is hosted on Shopify Inc., who provide us with the online e-commerce platform that allows us to sell our products and services to you.
Section 1 – Responsible Service of Alcohol & Liquor Licence
Amor Fati Wines supports the responsible service of alcohol. Under the Liquor Control Reform Act 1998 (Victoria) or relevant state legislation, it is an offence to supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.
By placing an order with Amor Fati Wines, you represent and warrant that you are at least 18 years of age. Amor Fati Wines operates under Victorian Liquor Licence No. 36313702.
We and our delivery partners reserve the right to request valid photo identification (such as an Australian Driver's Licence or Passport) upon delivery. If suitable proof of age cannot be provided, or if no adult over the age of 18 is present to accept the delivery, the courier will not leave the goods. In such events, the order may be returned to Amor Fati Wines, and any re-delivery fees will be at the customer's expense. If a refund is issued due to delivery failure under this clause, it will be less all shipping costs incurred.
Section 2 – General Conditions & Prohibited Uses
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; or (d) to transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of your Services.
Section 3 – Orders, Payments & Pricing
All prices on this website are listed in Australian Dollars (AUD) and include GST where applicable. Payment is required in full at the time of purchase through our secure e-commerce checkout.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue a product or Service without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
We reserve the right to refuse, limit, or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order (including orders placed under the same customer account, credit card, and/or billing/shipping address). If we cancel an order, we will attempt to notify you via the email or phone number provided at checkout and process a full refund promptly.
Section 4 – Shipping, Delivery & Local Restrictions
Shipping details, costs, and estimated timeframes are outlined on our Shipping Information page. Risk of loss and title for the products passes to you once the order has been delivered to the shipping address provided at checkout.
Amor Fati Wines complies with all state and territory delivery restrictions. We reserve the right to refuse delivery or cancel an order where local liquor licensing laws or dry zone restrictions apply.
Section 5 – Natural Wine Integrity, Variation & Storage
Amor Fati Wines partners with small growers who farm organically or biodynamically and practise low-intervention, minimal-sulphur winemaking. Because these are living, un-fined, and unfiltered products, the following conditions apply:
- Wine Storage: Amor Fati Wines stores all inventory under strict warehouse conditions at a stable temperature of approximately 14°C. Upon delivery, responsibility for ongoing storage and handling rests entirely with the customer. Wine is a perishable agricultural product; damage, alteration, or spoilage due to improper storage, exposure to heat, or extreme temperature fluctuations after delivery does not constitute a product fault.
- Weather Holds: To protect the delicate nature of low-intervention wines, Amor Fati Wines reserves the right to temporarily delay dispatch during periods of extreme heat (generally when forecast temperatures exceed 30°C along the transit route). We will notify you via email if your order is placed on a weather hold. If you explicitly request immediate dispatch against our seasonal recommendation, Amor Fati Wines accepts no liability for heat damage or cooked wine sustained during transit.
- Product Variation: Natural wines are characterised by minimal intervention. Minor sediments, cloudiness, vintage variations, and unique flavour profiles are natural traits of the product style, not technical faults. Refunds or exchanges cannot be offered based on subjective taste preferences.
Section 6 – Product Images, Accuracy & Description
We take great care to ensure that product descriptions and images are accurate and transparent. However, we rely in good faith on the information provided by our independent growers. We never claim formal organic or biodynamic certification for a product unless it is explicitly verified and stated on that individual wine page.
Minor variations may occur from time to time, including changes in vintage, label design, or packaging. These variations do not constitute grounds for a refund where the wine remains of identical producer and premium quality.
Section 7 – Accuracy of Billing & Account Information
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Your submission of personal information through the store is governed by our Privacy Policy.
Section 8 – Australian Consumer Law & Returns

Nothing in these Terms & Conditions is intended to exclude, restrict, or modify any non-excludable statutory rights you possess under the Australian Consumer Law (ACL). If a product suffers from a genuine technical fault (such as cork taint/TCA) or is damaged prior to delivery, you are entitled to a replacement or refund as provided by the ACL. To verify a technical fault, we reserve the right to require the bottle to be returned to us capped or corked with at least 75% of its original liquid contents intact for inspection.
Section 9 – Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk.
To the fullest extent permitted by law, Amor Fati Wines, our directors, officers, employees, affiliates, or contractors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, or replacement costs—arising from your use of the service or any products procured using the service. Nothing in this clause limits your rights under the Australian Consumer Law.
Section 10 – Indemnification & Severability
You agree to indemnify, defend and hold harmless Amor Fati Wines and our affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms without affecting the validity and enforceability of any remaining provisions.
Section 11 – Jurisdiction & Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Victoria, Australia. Orders are accepted subject to the local liquor licensing laws in the purchaser's state or territory of delivery.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those changes.
